About The Fletcher Firm

Why Choose Us

We have particular expertise in patent prosecution. We draft original U.S. and international applications and prosecute foreign origin applications, a highly demanding practice requiring excellent communication skills. In patent prosecution, we have the advantage of a location in Northern Virginia close to the U.S. Patent and Trademark Office. This allows us to engage in personal interviews with patent examiners frequently. We find personal interviews to be one of the best ways to serve clients and advance prosecution.

Information about Grand Juries Because grand juries are held more secretly than others, there is a lot misinformation. Television cop shows and lawyers have not helped. A grand jury may be called if you are suspected of serious crimes in Nevada. It depends. It depends.

Virtually every federal case begins with a grand jury indictment. However, in Nevada's state courts most cases don't involve any grand jury. Nevada grand jury indictments are sometimes sought by prosecutors in high-profile, serious and controversial cases. However, if your case is a Nevada felony, it's unlikely that the grand jury will be involved.

An experienced Las Vegas criminal defense lawyer will help you through the regular criminal proceedings. A grand jury proceeding is a secret hearing that may be held at the start of a Nevada criminal case. A grand jury hearing is when a prosecutor gives evidence about an alleged crime to 16-20 jurors. Grand juries do not determine whether a defendant is guilty or innocent.

Instead, they determine if sufficient evidence exists for the case to be brought against the suspect. Grand jurors will indict the accused if they believe that the evidence is adequate. The jury that will hear the trial case is not composed of the same people as the grand jury. The trial jury only has people who haven't heard your case, therefore grand jurors would not be included.

You will be permitted to testify if you are a defendant in grand jury proceedings. However, it is important to exercise the Fifth Amendment right not to incriminate. Grand jury hearings are a tool that prosecutors use to defend themselves. You could say something incriminating which could later be used against your incriminating evidence in criminal trials.

Nevada grand juries are sometimes requested by prosecutors in high-profile cases. While most Nevada defendants don't need to be concerned about the grand jury, criminals charged in Nevada will have other worries. Although Las Vegas is an open and welcoming city with many different cultures, Nevada's courts are strict on serious crimes. You should consult a Las Vegas criminal defense lawyer immediately if you are charged with either a misdemeanor, or felony.

Nevada has many innocent citizens convicted. Even though there is a trial jury and a grand jury, it's possible for an innocent person to be found guilty. Let's pretend that you are arrested in Las Vegas for bank robbery. But you realize that you are innocent.

The bank was not even in your immediate vicinity when you were robbed. It is impossible to be convicted. It is still common for innocent persons to be convicted of crimes that they did not commit. There is no guarantee that a particular case will be resolved.

However, if you are charged in Las Vegas with any crime and you believe you may not have committed the offense, contact a Las Vegas criminal defense attorney as soon as you can. While there are many reasons for wrongful convictions, such as false confessions or coerced confessions, and corruption of lab evidence, eyewitness misidentification is the most common reason. According to the Innocence Project (a non-profit that helps people get out of jail), 72 percent of those wrongly convicted for serious offenses were later exonerated on the grounds of misidentification of their eyewitness. According to the Innocence project, the second most common reason for wrongfully convicted people is unreliable witness testimony.

Innocence Project insists also that race, class and gender can sometimes be factors in wrongful conviction situations. You may find that law enforcement officers will misinterpret something you have posted online and then use it against your. Detectives and investigators often use social media as part of a criminal investigation to verify links, deny or confirm alibis and find statements, photos, and videos implicating suspects. It doesn't matter what privacy settings you use, nothing you post online can be considered private.

Even if you do delete something it is still there. All of it is recorded. A grand jury can recommend that a prosecution file charges against someone based upon untrue testimonies and facts. The legal system was designed to punish guilty people and exonerate innocent ones.

The legal system, however, is a tool for people. As you have seen, there are many flaws in the law. Sometimes innocent people are wrongly convicted because cops can make mistakes and crimes sometimes go unsolved. You have the right to refuse to speak if you are charged in Las Vegas with any crime.

Get the help that you need by contacting a Las Vegas criminal defense attorney as soon as possible. Be honest and open with your attorney. It is important to follow your lawyer's instructions and carefully consider his or her suggestions. The lawyer-client confidentiality protects all communications between you and your defense attorney.

If your lawyer requests the entire story, it is possible to tell it freely. Be sure to tell your lawyer the truth. If you lie to your attorney, you could make it more difficult to defend you. The right to an attorney for anyone indicted on a United States crime is a fundamental constitutional right.

If you are being interrogated, or even arrested, make sure that your attorney is present. You must ensure that you are protected by the law and that all sides of your story are heard. Talk to an attorney as soon as you can if you face a Las Vegas-area criminal case. Maysoun Fetcher, 2019-07-19T02:02 17-07 00February 7, 2015, criminal defense Comments Off about Grand Juries.
